Private IP VPN Service Supplement

This Private IP Virtual Private Network Service Supplement (“PIP VPN Supplement”), together with the Service Orders under which Customer orders Airband Private IP VPN (“PIP VPN” or “Services”) and the Airband Standard Terms and Conditions (“Standard Terms and Conditions”) found at www.airband.com/GeneralTerms&Conditions011510.pdf are collectively referred to herein as the “Agreement.” The Agreement will govern Customer’s use of Airband Private IP VPN and provisioning of the Private IP VPN by Airband or any of Airband’s Affiliates.

  • Services Description
  • PIP VPN is an OSI model Layer 2 or Layer 3 “tunnel” through the Airband Network creating a virtual private network connectivity between the customer locations for the bandwidth goal set forth on the applicable Service Order and described in the design diagram prepared by Airband, approved by Customer (“Design Diagram”). The Design Diagram is incorporated herein by this reference. IP VPN utilizes IP addresses typically assigned by the customer, but can be assigned by Airband upon request and qualification pursuant to Airband’s then-existing policies. If assigned by customer, Airband shall have no responsibility or liability in connection with IP addresses.

    Private IP VPN provides Customer with access to the Airband network through a connection into a router or switch as set forth in the Design Diagram. The primary service components for the Services are a port and customer access on each end of the PIP VPN tunnel. Airband will charge Customer, and Customer will pay, a Monthly Recurring Charge and a Non-Recurring Charge for the Service.

  • Service Upgrades
  • Customer may upgrade existing PIP VPN before a Service Term for that Service expires without incurring early termination liabilities for the terminated Service if Customer submits a Service Order for the upgraded PIP VPN in strict compliance with the following: (A) The upgraded Service is at the same locations as the replaced Service; (B) the Service has greater bandwidth than the replaced Service; (C) the Service is installed before the replaced Service is disconnected; and (D) the upgraded Service has a Service Term equal to or greater than the remaining Term of the replaced Service, subject to a one year minimum Service Term from the Service Activation Date of the upgraded Service; and (E) Customer pays the NRC associated with the upgraded Service. All Service upgrades are subject to Airband’s acceptance, and Airband shall have no obligation under any circumstances to accept any request for a Service upgrade.
